Josh Dugger is doing everything possible to get out of child pornography charges.
E! obtained court documents from the court. E! News obtained court docs that show that the former TLC star’s legal counsel filed motions to dismiss two charges against him, one of child pornography receiving and one of possessing child pornography. Their reasoning is absurd!
Duggar’s team argued that the government had failed to preserve potentially exonerating evidence in the first motion. They argued in another motion that the indictment should not be filed because the US Department of Homeland Security acting secretaries at the time of the Duggar investigation were not properly appointed.

You’re right, y’all: They’re pointing out a technicality that has absolutely nothing to do the crimes the 19 Kids Counting alum allegedly committed. (But, we should point out that even if Josh’s charges are dismissed, which would temporarily remove his charges, the feds can still issue a new one — this is not a double jeopardy matter.)
Duggar’s lawyers also filed three motions to suppress evidence in this case. These included all statements that the disgraced reality star made before investigators seized his phone and before the 33 year-old could call his lawyer. Hmm. Hmm.
Intriguingly, another motion was filed to block Duggar from taking photos of his hands and feet while he was under arrest. According to Duggar’s team, investigators allegedly did not have a warrant to authorize the photo take. It is not clear why the photos were taken. Josh believes it’s important. We don’t have the time to speculate on all possible reasons.

We reported in April that the Arkansas feds had arrested the former activist for allegedly downloading child pornography. In a recent hearing, a federal agent stated that Duggar’s computer contained images that showed child sexual abuse. The file was found on Duggar’s computer and included a file that depicted the abuse of children aged between 18 months and 12 years.
After pleading not guilty, the father-of-six was released from jail on May bail. In a statement to E, his attorneys stated that he was innocent of all charges. News:
“We will vigorously defend this case. Prosecutors can charge anyone in this country with a crime. However, you can fight back in courtroom if you are accused. Josh plans to do just that.”
He will be tried in November.
